Who Can Contest My Will?

Any Will can be contested by someone who may feel aggrieved at not being included adequately in your Will or concerned that the Will was made against your best interests. There are 5 grounds that a Will can be contested for: –

  1. Testamentary Capacity – You didn’t have the mental capacity to sign or understand your Will, rendering it invalid.
  2. Fraud and Undue Influence – Your Will was fraudulently created and signed by you under duress.
  3. Invalid Execution – Your Will wasn’t signed or executed properly.
  4. Lack of Knowledge and Approval – You didn’t understand what the contents of your Will were (e.g. a substantial gift to someone who wrote your Will) or you weren’t aware of the Will.
  5. Inadequate Provision – Someone may claim against your estate if they are a member of your close family or they are someone who were financially dependent upon you, immediately prior to your death and they have had an inadequate or no provision from your estate, and they should otherwise have.
