Can an Islamic Will / Sharia Law Will, be made in England?

In England and Wales, there is currently no legislation that deals with Sharia Law Wills. For a Will in England and Wales to be compliant with Sharia Law, the terms of the Will need to be in accordance with Sharia Law. You can distribute your Will as per Sharia Law and specify any funeral wishes you require in the Will, in accordance to Sharia Law.

There may be times when Sharia Law is not compliant with the law of England and Wales and you may exclude a family member or dependant that really ought to inherit under statute. It is therefore important to prepare a separate Letter of Wishes explaining the reasons why you’ve come to the decision you have, if this is because of your religion then this is a good reason to place into the Letter of Wishes for the court to consider in the event of a claim against your estate. It is also important to point out that to have a Will in England and Wales, you must be domiciled in England or Wales, this means you must either live or it is your intention that your permanent country of residence is England or Wales.
